Pixgallery.ca is an Internet site managed by Jean Bonnard, a sole proprietorship not registered with the Quebec Enterprise Registrar as authorized by law.
All orders for photographic prints imply full acceptance of the present terms of sale.
Pixgallery.ca reserves the right to modify these terms and conditions at any time. In the event of modification, the general terms and conditions of sale in effect on the day the order is placed will apply.
Technical data, measurements and other descriptions in the form of text or photographs available on the Pixgallery.ca website are provided for information purposes only.
Intellectual property
All texts, logos and photos on the Pixgallery.ca site or distributed by e-mail are the full and complete property of Pixgallery.ca. Any reproduction or representation, in whole or in part, is prohibited without prior authorization from Pixgallery.ca.
Products
Pixgallery.ca sells prints of professional-quality photographs, printed on paper using inkjet technology.
Limited and controlled use of AI
Artificial intelligence may be used in certain specific contexts:
- to illustrate concepts in the Ideas & Concepts section
- to test or evaluate visual ideas
- to create mock-ups, staged scenes, or decoration examples
AI is never used to:
- alter documentary reality
- produce photographs intended for galleries
Warranty and copyright
The photographer declares that he/she is the author of the photograph sold through Pixgallery.ca and guarantees that he/she holds all rights pertaining thereto.
In particular, the photographer guarantees:
- That the photograph does not contain any element likely to infringe the rights of third parties and to give rise to legal action, notably for plagiarism, counterfeiting or civil liability;
- That outside the so-called public domain, he or she has obtained the necessary authorizations from any persons represented in the photograph, notably for the use of their image.
The photographer is liable for any failure to comply with these commitments, as required by law.
- Photographs are supplied for the sole purpose of personal use. It is strictly forbidden to sell them or to use them to promote a company or a person, except in the case of a distribution license agreement on the present contract. If any of the photographer’s images are published or reproduced (on the web or any other media), the “Pixgallery.ca” watermark is required.
- The customer assumes all responsibility for any form of copyright infringement. Pixgallery.ca retains its copyrights to all photographs at all times and anywhere in the world. Furthermore, it is strictly forbidden to retouch and/or modify the images in any way whatsoever. The images remain the property of Pixgallery.ca and any modification must be approved and carried out by Pixgallery.ca.
Conformity of the reproduction
The reproduction is sold as it appears on the Pixgallery.ca website. However, Pixgallery.ca is not responsible for minor differences, resulting from printing techniques, that may exist between the image presented on the site and the reproduction.
Orders
Photographs are sold while stocks last. The final validation of the order occurs when the payment is completed. Once your order has been finalized, you will receive an e-mail confirming its registration via Paypal, with a summary of the items ordered and any delivery terms.
Prices
All prices indicated on the site are in Canadian dollars, excluding taxes, shipping costs and customs duties. They may be modified at any time, but such modifications will not apply to orders placed.
Taxes
The amount of taxes to be paid is determined by the delivery address: GST and QST are applied for delivery addresses located in Quebec, GST only for delivery addresses located in the rest of Canada. For addresses in the rest of the world, no tax applies.
Shipping costs
In addition to the price of the products (and taxes where applicable), you will be required to pay a contribution towards the cost of shipping and processing your order. The amount of this contribution will be specified on the order form before it is validated.
Customs
Customs fees are the responsibility of the buyer.
Payment
Payment for purchases is made via the Paypal secure payment system. For more information on Paypal, see the section on the Paypal website.
Delivery
Pixgallery.ca ships to Canada, the United States and Europe via Canada Post. Delivery may take 1 to 3 weeks depending on the country of delivery.
Delivery charges depend on the country and region of delivery.
Pixgallery.ca cannot be held responsible for shipments after they have been turned over to the shipping company. Pixgallery.ca is therefore not responsible for delays, theft, loss or any other damage related to shipping. In the event of a dispute, the customer must deal directly with the company responsible for transporting the package.
Delivery may not be guaranteed in cases of force majeure.
Exchanges and refunds
The customer has a period of 15 days after purchase to request an exchange or refund of a product ordered from Pixgallery.ca. This request must be made in writing and by returning the merchandise to Pixgallery.ca. The customer must specify his or her name, complete contact information, order number, reason for return and, if applicable, the references of the product desired in exchange.
In case of return of merchandise due to quality damage or manufacturing problems, Pixgallery.ca will assume the shipping costs. In all other cases, the customer is responsible for return shipping costs.
Items returned damaged or soiled by customers will not be accepted.
For exchanges, the customer must pay a flat-rate fee corresponding to the cost of sending and processing the request.
The price of the products will be reimbursed within 30 days following receipt of the defective merchandise by Pixgallery.ca.
In the event of abnormal or abusive returns, Pixgallery.ca reserves the right to refuse a subsequent order.
Site availability
Pixgallery.ca makes every effort to ensure the security and quality of navigation on its site. However, Pixgallery.ca does not guarantee uninterrupted or error-free access to the site, or that the site is free of viruses or other harmful components. Pixgallery.ca makes no warranties, express or implied, and specifically disclaims all warranties regarding the availability and suitability of the site’s functions and the site’s ability to meet the user’s expectations or needs. Pixgallery.ca shall not be held liable for any direct or indirect damage resulting from the user’s inability to use the site.
Applicable law
In the event of a dispute, an amicable solution will be sought before any legal recourse. Any dispute relating to the Pixgallery.ca site is governed by the federal and provincial laws of Canada. The courts and tribunals of the judicial district of Montreal have exclusive jurisdiction.
